Web Hosting Terms of Service

All clients must agree to and follow the following Terms of Service. Failure to do so may result in account suspension or termination.

Introduction

For the purposes of this agreement, 'CLiK Development' refers to 'CLiK Development Ltd.', a registered UK company, Company No. 278682.

Illegal Use

CLiK Development does not allow the use of our services for the following activites:

publish, post, distribute or disseminate defamatory, infringing, obscene, indecent or other unlawful material or information;
threaten, harass, stalk, abuse, disrupt or otherwise violate the legal rights (including rights of privacy and publicity) of others;
engage in illegal or unlawful activities;
make available / upload files that contain software or other material protected by intellectual property laws (or by rights of privacy or publicity) unless the Customer owns or controls the rights thereto or have received all necessary consents;
make available / upload files that contain a computer virus or corrupted data;
falsify the source or origin of software or other material contained in a file that the Customer makes available on their web pages;
use email services for spamming;
act, or fail to act, in the Customer's use of the web pages, in a manner that is contrary to applicable law or regulation. The Customer is entirely responsible for any civil or criminal liability which is incurred as a result of their use of the web pages.

Server Resources

Any subscriber found to be using up vast amounts of server resources (bandwidth, CPU time, etc.) will receive an immediate warning, and asked to upgrade their hosting plan to allow for the extra use.

Servers

At CLiK Development we do not permit the use of anything that listens on a port. This is considered to be a server.

Security

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include but are not limited to the following: unauthorized access, use, probing, or scanning of systems security or authentication measures, data, or traffic; interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Payments

CLiK Development accept payments via PayPal and Direct Debit. Other payment methods may be possible at the discretion of CLiK Development. You are protected against possible price increases throughout the period of your subscription.

Refunds

All payments made to CLiK Development are non-refundable after 14 days of payment being recieved. All fees paid for domain names are non refundable.

Domain Names

Domain names are all registered in the name of CLiK Development and with our details as a security measure. Registration is with third party companies with CLiK Development acting as your agent.

Actions taken by CLiK Development

At CLiK Development we reserve the right to modify, terminate, suspend or do anything to an account that we wish, within reason and if we feel that the client is breaking the rules set by these terms of service. We also reserve the right to change and/or modify hosting packages without giving prior notice, and we also reserve the right to refuse refunds if packages do change.

Responsibility and Limitation of Liability

CLiK Development is not responsible, and cannot be held responsible for the content of its users sites. If you feel that one of our hosted sites is breaking these terms of service, please contact us immediately at support@CLiKdevelopment.co.uk. We also cannot be responsible for server downtimes as some are unpreventable, and we therefore reserve the right to exceed the amount of downtime that we state throughout the website and to customers. CLiK Development will at all times use best endeavours to attempt to maintain and safeguard the Customer's data on its system. However CLiK Development accept no responsibility for any loss or damage to data or the loss thereof. The Customer's use of CLiK Development's services is at their own risk. The Customer accepts full responsibility for such use and the risk of any loss resulting from their use of the system and the content of their pages. The Customer also accepts full responsibility for safeguarding their own data. Notwithstanding contrary clauses in this Agreement, in the event that CLiK Development are deemed liable to the Customer for breach of this Agreement, the Customer agrees that CLiK Development's liability is limited to the amount actually paid by the Customer for their subscription. The Customer hereby releases CLiK Development from any and all obligations, liabilities and claims in excess of this limitation.

We are not responsible for anything posted on the system (except by one of our staff) and the Customer agrees by using the system that CLiK Development will not be liable for any possible damages or losses incurred in connection with the use of the system, even if CLiK Development have been advised of this possibility and the Customer hereby waives any claims with respect thereto and the Customer agrees to indemnify CLiK Development and hold CLiK Development harmless from and against any and all reasonable claims, proceedings, damages, injuries, liabilities, losses, costs, and expenses (including reasonable legal defence and other legal costs) incurred as a result of the Customer's actions on the system or materials or information transmitted by the Customer in connection with the system. This means the Customer may have to pay CLiK Development where claims are made against us or our system by other callers or third parties.
